Terms & Conditions
Clear before commitment. Everything we promise, in writing.
This is our current standard agreement. The Terms & Conditions included in your signed proposal are the ones that apply to your project.
The short version
- No deposit. Your first payment is due only after you approve and sign off on your design.
- Your build clock. Your Guaranteed Build Period starts on the Build Start Date we confirm in writing. If we finish late, we credit you $100 for every Working Day we’re late, as set out in Section 10.
- What pauses the clock. Changes you request, items you order, unforeseen conditions and delays in decisions or access pause the clock. We let you know every time.
- Your team. One CraftHaus team and Team Lead from start to finish. You meet everyone before they start.
- Working hours. 8:00 a.m. to 6:00 p.m., Monday to Friday.
- Access. Please have a lock box or agreed access ready before the build starts.
- Belongings. Unless your Package includes packing and storage, please clear the Work Area before the build starts.
- Changes. Every change is reviewed with you and the Project Manager and confirmed in writing before it is done.
- Questions. Go to your Project Manager, not directly to team members.
The full agreement
These Terms & Conditions form part of the renovation agreement (the “Agreement”) between CraftHaus Renovations (“CraftHaus” or the “Renovation Partner”) and the client named in the applicable proposal or contract (the “Client”).
CraftHaus does not take a deposit, other than the optional Material Price Lock in Section 23. No payment is due until the Client has approved and signed off on the final design, and every Guaranteed Build Period is backed by the On-Time Guarantee in Section 10.
01Purpose+
This Agreement sets out the terms under which CraftHaus will design and carry out the renovation described in the approved proposal, Scope of Work, drawings, Fixture Sheet, Change Orders and other approved project documents.
02Definitions+
- Contract Price: the fixed price for the Scope of Work stated in the proposal, plus applicable taxes, as adjusted only by approved Change Orders.
- Package: the CraftHaus renovation package selected by the Client in the proposal, including any Added Value items listed for that Package.
- Design Approval: the date the Client signs off on the final design, drawings and selections in writing.
- Technical Walkthrough: the on-site meeting before the build where the Client, the Project Manager and the Team Lead confirm final measurements, design details and site conditions.
- Build Start Date: the first Working Day of construction, set under Section 9.
- Guaranteed Build Period: the number of Working Days for completing the build, as set out in Section 9.
- Build Clock: the count of Working Days used toward the Guaranteed Build Period. It starts on the Build Start Date and pauses only as set out in Section 11.
- Guaranteed Completion Date: the date the Build Clock reaches the end of the Guaranteed Build Period.
- Working Day: Monday to Friday, 8:00 a.m. to 6:00 p.m., excluding Ontario statutory holidays.
- Substantial Completion: as defined in Section 10.4.
- Final Completion: the point at which all deficiencies on the final walkthrough list have been corrected.
- Work Area: any area CraftHaus designates for construction, demolition, staging, material storage or equipment.
- Active Work Hours: any time CraftHaus team members are working or operating equipment at the property.
03Scope of Work+
CraftHaus will perform the work described in the approved proposal and Scope of Work in accordance with applicable laws, building codes and the approved plans and specifications.
CraftHaus will perform the work with reasonable care and accepted construction practices and is responsible for the work of everyone it brings to the property.
Only work expressly identified in the approved Scope of Work is included in the Contract Price. Any other work, material, service or finish is excluded unless added through an approved Change Order.
Before signing, the Client has reviewed the proposal, Scope of Work, drawings, Fixture Sheet and specifications. The Client should raise any requested change or discrepancy before work on that item begins.
04Design, Renderings & Dimensions+
Design for the renovation is included in the Contract Price. CraftHaus presents sketches, drawings and renderings before Design Approval, and no construction begins until the Client has approved the final design in writing.
Renderings and design drawings are tools for showing the intended design. Unless identified as architectural, structural or engineering drawings prepared by a qualified professional, they are not construction or engineering documents.
Measurements in conceptual drawings may be approximate. Actual dimensions, layouts and positions may need reasonable adjustment because of site conditions, field measurements, building tolerances, concealed conditions, product specifications or code requirements. CraftHaus will tell the Client before making any adjustment that visibly changes the approved design.
Ownership of designs. All designs, drawings, renderings, plans, measurements and dimensions prepared by CraftHaus are the property of CraftHaus Renovations, including their copyright. CraftHaus shares them with the Client, usually by a view-only link, so the Client can review and approve the design. Sharing them does not transfer ownership.
Until the Contract Price has been paid in full, the Client may use them only to review and approve the design and to have the work carried out by CraftHaus. The Client may not share them with anyone else, or use them to obtain quotes or work from anyone else. Once the Contract Price has been paid in full, the Client may keep and use them for their own home, such as for maintenance, insurance or future reference. CraftHaus keeps the copyright.
If the Client does not proceed with CraftHaus and uses or shares the designs to have the work quoted or carried out by someone else, the Client agrees to pay CraftHaus a design fee of $972 plus HST.
05Concealed & Unforeseen Conditions+
Renovation work can uncover conditions that could not reasonably have been identified before demolition, such as:
- Water or moisture damage, mould or rot
- Damaged or inadequate framing or structure
- Out-of-level floors, walls or ceilings
- Plumbing, electrical or mechanical deficiencies
- Previous construction that does not meet current code
- Asbestos, lead or other hazardous materials
If such a condition is found, CraftHaus will stop the affected work, show the Client what was found, and explain the options, cost and any schedule impact. Correcting it is outside the Contract Price and will proceed only through an approved Change Order.
If suspected hazardous materials are found, work in the affected area stops until they are tested and, where required, removed by a qualified specialist in accordance with applicable law.
06No Deposit+
CraftHaus does not require a deposit to reserve the Client’s project or start period. No payment is due under this Agreement until Design Approval. The only exception is the optional Material Price Lock in Section 23, which is the Client’s choice.
Nothing in this Agreement limits any cancellation or refund right the Client has under Ontario consumer protection legislation or other applicable law.
07Payments+
Payments are due on the milestones below, unless the proposal or the Client’s financing documents set out a different written schedule, in which case that schedule governs.
Non-financed projects:
25% – Due at Design Approval
20% – Due at the Build Start Date
40% – Due at the mid-project milestone stated in the proposal
10% – Due at Substantial Completion
5% – Due at Final Completion
Financed projects:
40% – Due at Design Approval
40% – Due at the mid-project milestone stated in the proposal
20% – Due at Final Completion
All amounts are subject to applicable HST. Any On-Time Guarantee credit is applied against the final payment as set out in Section 10.
If a payment is not made when due, CraftHaus may, after giving any notice required by law, pause the work until payment is received. The Build Clock pauses until payment is received, and reasonable remobilization or storage costs caused by the late payment may be charged to the Client.
08Change Orders+
The Contract Price is fixed. It changes only if the Client adds, removes or changes work through an approved Change Order.
Every change is reviewed with the Client and the Project Manager before it is approved. A Change Order is in writing, signed or approved electronically by both parties, and states:
- The change to the work, materials or design
- The added cost or credit
- Any effect on the Build Clock under Section 11
- When any added cost is payable
CraftHaus is not required to start changed or additional work until the Change Order is approved and any payment it requires has been made. Verbal requests to team members are not Change Orders.
09Build Schedule+
The Guaranteed Build Period is:
Bathroom – 9 Working Days
Kitchen – 23 Working Days
Whole floor – 41 Working Days
For any other project, including a whole-home renovation or a project combining more than one of the above, the Guaranteed Build Period is stated in the proposal.
CraftHaus will confirm the Build Start Date to the Client in writing once all of the following are in place:
- Design Approval has been given.
- All required permits and approvals have been issued.
- All CraftHaus-supplied materials for the build are on site or in CraftHaus’s possession, including any special-order or custom item.
- The Client has completed the preparation required by this Agreement, such as clearing the Work Area and providing access, unless the Package includes those services.
The Client’s dedicated CraftHaus team will be on site every Working Day of the build, except for days planned into the schedule for curing, drying or inspections. Planned no-work days are shown to the Client before the Build Start Date and count toward the Guaranteed Build Period.
10On-Time Guarantee+
10.1 The promise. If Substantial Completion is not reached by the Guaranteed Completion Date, CraftHaus will credit the Client $100 for each Working Day after the Guaranteed Completion Date until Substantial Completion is reached.
10.2 Maximum. The total credit will not exceed 5% of the Contract Price.
10.3 How the credit is paid. CraftHaus calculates the credit at Substantial Completion and confirms it to the Client in writing. The credit is deducted from the final payment. If the credit is more than the amount still owing, CraftHaus refunds the difference within 10 Working Days of Final Completion. The credit is not paid during the project and does not allow the Client to withhold any other payment.
10.4 Substantial Completion.
What it means. Substantial Completion means the renovated room can be used safely for its normal everyday purpose. It is about the room working, not about it being perfect or fully finished. Finishing work, touch-ups and deficiency items may still remain.
The test is simple: if every item on the “reached when” checklist below for that room is done, the room is substantially complete. Nothing else is required, and nothing on the “does not delay” list can be used to say otherwise.
Bathroom – reached when:
- The toilet is installed and flushes.
- The sink and faucet run hot and cold water and drain.
- The shower and/or tub runs hot and cold water and drains, and waterproofing is complete.
- The floor is installed and can be walked on.
- The lighting, exhaust fan and at least one receptacle work.
- There are no active leaks, exposed live wiring or open holes in the floor.
Bathroom – does not delay Substantial Completion:
- Painting, primer or paint touch-ups
- Grout sealing, caulking or silicone curing time
- Switch plates, cover plates, vent covers, escutcheons, baseboards, door casing or other trim
- Accessories such as towel bars, toilet paper holder, robe hooks, mirror or medicine cabinet
- Custom shower glass or door measured after tiling, where a temporary curtain is provided
- Cabinet or door hardware, or adjustment of doors and drawers
- Minor cosmetic marks, scratches, chips or alignment adjustments
Example: On Day 9, the toilet flushes, the vanity and shower run hot and cold and drain, the floor is down, and the lights and fan work. The mirror, towel bar and shower glass are not yet installed, and one wall needs a paint touch-up. The bathroom is substantially complete on Day 9, and no credit applies.
Example: On Day 9, the shower valve leaks. The bathroom is not substantially complete. The credit applies from Day 10 until the leak is fixed and the checklist is met.
Kitchen – reached when:
- Base cabinets are installed and secured.
- Countertops are installed.
- The sink and faucet run hot and cold water and drain.
- CraftHaus-supplied appliances are installed, connected and working.
- Ceiling lighting and countertop receptacles work.
- The floor is installed and can be walked on.
- There are no active leaks, exposed live wiring or open holes in the floor.
Kitchen – does not delay Substantial Completion:
- Backsplash tile or backsplash finishing
- Painting, primer or paint touch-ups
- Cabinet hardware, door and drawer adjustment, crown moulding, light rail, filler strips, toe kicks or end panels
- Under-cabinet or decorative lighting
- Switch plates, cover plates, baseboards, caulking or other trim
- Appliances ordered or supplied by the Client, or their hookup
- Minor cosmetic marks, scratches, chips or alignment adjustments
Example: On Day 23, the cabinets and countertops are in, the sink runs and drains, the CraftHaus-supplied range and dishwasher work, and the lights and counter outlets work. The backsplash tile, crown moulding and cabinet handles are still to be installed, and the Client’s fridge has not been delivered. The kitchen is substantially complete on Day 23, and no credit applies.
Whole floor – reached when:
- Every bathroom and kitchen on the floor meets its own checklist above.
- Flooring is installed in every room in the Scope of Work.
- Walls and ceilings are closed in with drywall.
- Doors are hung on bathrooms and bedrooms.
- Lighting, receptacles and heating work in every room in the Scope of Work.
- Stairs and railings in the Work Area are safe to use.
- There are no exposed live wiring, open holes or tripping hazards.
Whole floor – does not delay Substantial Completion:
- Painting, primer or paint touch-ups
- Baseboards, door casing, window trim, crown moulding or other trim
- Closet doors, closet shelving or door hardware
- Switch plates, cover plates and vent covers
- Any item listed as not delaying a bathroom or kitchen
- Minor cosmetic marks, scratches, chips or alignment adjustments
Example: On Day 41, the bathroom and kitchen meet their checklists, the flooring is down, drywall is finished, bedroom and bathroom doors are hung, and every room has working lights, outlets and heat. The baseboards in two bedrooms and the closet doors are still to be installed, and the walls have not had their final coat of paint. The floor is substantially complete on Day 41, and no credit applies.
For every project, the following also never delay Substantial Completion:
- Items on the deficiency list under Section 24
- Items the Client ordered, supplied or asked to change, while CraftHaus is waiting for them
- Final inspections that have been booked but not yet attended by the authority
- Final cleaning
For any other type of project, the proposal sets out the “reached when” checklist.
How it is confirmed. When the checklist is met, CraftHaus and the Client walk through the room together and CraftHaus confirms Substantial Completion in writing. If the Client believes a checklist item is not met, they must name that item in writing within 24 hours of the walkthrough. If they do not, Substantial Completion stands as confirmed.
10.5 Good faith. The On-Time Guarantee is given in good faith to show CraftHaus’s commitment to finishing on time. Both parties agree to work together to meet the Guaranteed Completion Date. No credit is earned for any Working Day lost because of the Client’s actions or delays, including postponing or rescheduling meetings, decisions, approvals, access or payments.
If the Client does not respond to a reasonable request for a decision or approval within 24 hours, the Build Clock pauses until the Client responds.
10.6 Other rights. The On-Time Guarantee is in addition to, and does not limit, any right or remedy the Client has under applicable law.
11When the Build Clock Pauses+
The Build Clock counts only Working Days on which CraftHaus is able to carry out the planned work. It pauses for as long as any of the following affects the work, and restarts once the cause is resolved:
- Concealed or unforeseen conditions (Section 5): from when CraftHaus stops the affected work until the condition has been corrected and the original work can resume.
- Changes requested by the Client, including Change Orders, upgrades and substitutions of an item already selected or installed: from when the change is requested until any new item has arrived and the work can resume.
- Items the Client orders or supplies, such as appliances: for as long as CraftHaus is waiting for them.
- Client delays: late decisions, selections, approvals or payments; missed or rescheduled meetings; restricted access; or interference with the work.
- A pause requested by the Client.
- Inspections that the authority does not attend on the date booked.
- Utility interruptions by third-party utility providers.
- Severe weather affecting exterior work.
- Events beyond CraftHaus’s reasonable control, such as fire, flood, strikes or public emergencies.
For example, during a 9-Working-Day bathroom build, the Client asks on Day 4 to replace the installed toilet with a different model. The Build Clock stops at Day 4 and restarts when the new toilet arrives and installation resumes, leaving 5 Working Days on the Build Clock.
Working hours. If the Client needs CraftHaus to work outside, or for less than, the standard 8:00 a.m. to 6:00 p.m. working day, the parties will review the Guaranteed Completion Date together and confirm any change in writing.
Notice. Whenever the Build Clock pauses, CraftHaus will notify the Client within 2 Working Days, stating the cause and the day the Build Clock stopped, and will confirm the updated Guaranteed Completion Date when the Build Clock restarts. Notice is given through the project WhatsApp group or another communication channel established with the Client.
Supplier delays. Once the Build Start Date has been set, backorders, supplier delays and labour availability do not pause the Build Clock, unless they result from a change or item requested by the Client.
12Our Team+
CraftHaus performs the work with its own employed team, led by one Team Lead from start to finish and overseen by the CraftHaus Project Manager.
No stranger danger. The Client meets their Team Lead and team before the Build Start Date, and anyone new who joins the team is introduced to the Client before they start work in the home. From time to time, people the Client has not met may need to attend, such as municipal or third-party inspectors. No one enters the site unless they have been arranged or authorized by CraftHaus, so CraftHaus always knows who is in the Client’s home.
All work is carried out by professional CraftHaus team members.
13Protecting Your Home+
CraftHaus will take reasonable precautions to protect the Work Area, the Client’s property and neighbouring property from damage caused by its work, including dust containment between the Work Area and the rest of the home.
CraftHaus will keep the site reasonably clean, remove construction waste at regular intervals, and leave the Work Area clean at completion.
Renovation work creates some noise, vibration and temporary disruption. Reasonable construction noise or dust inside the Work Area is not damage or defective workmanship.
CraftHaus will comply with Ontario occupational health and safety legislation for everyone working at the property.
14Access, Safety & Working Hours+
Working hours are 8:00 a.m. to 6:00 p.m., Monday to Friday, subject to municipal by-laws and condominium rules. If the Client needs different working hours, the Guaranteed Completion Date is reviewed under Section 11.
Where needed, the Client will provide a lock box or another agreed method of access before the Build Start Date and keep it available until completion. Once access is set up, the CraftHaus team may attend during working hours without separate notice each day.
For safety and insurance reasons, the Client, family members and guests should not enter the Work Area during Active Work Hours, except for brief visits arranged with the Team Lead or Project Manager. Visitors must follow site-safety instructions, stay within designated areas and not handle tools, equipment or materials.
The Client should keep children and pets out of the Work Area at all times.
If unsafe or unauthorized access creates a safety risk or materially interferes with the work, CraftHaus may pause the affected work until it is resolved. The Build Clock pauses for any delay this causes, under Section 11.
15Belongings, Furniture & Appliances+
Unless the Client’s Package includes packing, moving and storage, the Client will remove personal belongings, furniture, valuables and appliances from the Work Area before the Build Start Date. Anything that cannot be moved should be pointed out to CraftHaus so it can be protected.
Where the Package includes packing, moving and storage, CraftHaus will pack, move and store the items listed in the proposal and return them at completion. Cash, jewellery, important documents, medication and similar valuables remain the Client’s responsibility.
CraftHaus is not responsible for damage to belongings the Client left in the Work Area after being asked to remove them, except where caused by CraftHaus’s negligence.
16Storage Space & Waste+
The Client will provide reasonable space at the property for materials, equipment and temporary storage of construction waste or a bin, subject to municipal and condominium rules.
The Client will not move, use or dispose of CraftHaus tools, materials or equipment.
Removal of household items or waste not created by CraftHaus’s work is not included unless listed in the Scope of Work.
17Materials & Selections+
Materials, fixtures, finishes and colours are chosen from CraftHaus’s catalogue and samples during design and recorded in the Fixture Sheet, drawings or Change Orders.
All selections are finalized at Design Approval. A change to an approved selection after Design Approval is made by Change Order and may affect the price and the Guaranteed Completion Date.
If the Client wants an item outside the catalogue, CraftHaus will source it or build it in its own workshop, priced as an upgrade. The Build Start Date is set only once that item has been received.
If an approved product is discontinued or unavailable before it is ordered, CraftHaus will offer a comparable alternative for the Client’s approval. Any price difference is handled by Change Order.
18Client-Supplied Materials+
CraftHaus supplies all materials and fixtures in the Scope of Work. CraftHaus does not install materials, fixtures or appliances supplied by the Client unless this is expressly agreed in writing at or before the Technical Walkthrough.
Where CraftHaus agrees to install a Client-supplied item, the Client is responsible for its quality, suitability, completeness and timely delivery, and CraftHaus does not warranty the item or its performance. Any wait for the item pauses the Build Clock under Section 11, and extra labour caused by missing parts, wrong items or defects is additional work.
19Paint+
Paint colours and sheens are selected before Design Approval and recorded in the Fixture Sheet. Repainting requested after a surface has been painted in the approved colour is additional work.
20Additional Electrical Points+
Electrical work in the Scope of Work is included in the Contract Price. All electrical work, including adding or moving electrical points, is completed to code by an ESA-licensed member of the CraftHaus team, and ESA certificates are issued for the work.
Unless the proposal says otherwise, each additional standard electrical point the Client requests (a pot light, switch or receptacle) is charged at CraftHaus’s standard per-point rate plus HST, confirmed in writing through a Change Order. This assumes normal installation conditions. Dedicated circuits, panel work, specialty devices, difficult access, or drywall or concrete repair are priced separately.
21Permits & Inspections+
Where applicable, CraftHaus obtains the building permits required for the Scope of Work and books all required inspections. Permit fees are included in the Contract Price only where the proposal says so.
Engineering, architectural or other third-party professional fees are not included unless listed in the proposal.
If an authority requires work because of pre-existing conditions outside the Scope of Work, that work is handled by Change Order.
CraftHaus will not perform work that does not comply with applicable law, even at the Client’s request.
22Insurance+
CraftHaus carries $5,000,000 in commercial general liability insurance and maintains the workplace safety and other insurance coverage required by law. A certificate of insurance is available on request.
The Client remains responsible for property and homeowner’s insurance and should tell their insurer about the renovation if their policy requires it.
23Fixed Price+
The Contract Price will not increase because of changes in material or labour costs after the Agreement is signed. It changes only through an approved Change Order.
The one exception: if the Build Start Date is more than 60 days after the Agreement is signed, and the cost of materials not yet purchased rises significantly and unforeseeably in the meantime, CraftHaus may discuss a price adjustment with the Client before buying those materials, with supplier documentation of the increase. No adjustment is binding unless the Client approves it in writing.
Material Price Lock. If the Client wants to guarantee current material prices for a project with a Build Start Date more than 60 days after signing, CraftHaus can buy the materials in advance in exchange for a Material Price Lock deposit, in an amount agreed in writing. The following conditions apply:
- CraftHaus buys the materials only after any statutory cooling-off period has ended. During that period, the deposit is refundable as required by law.
- The deposit is applied to the Contract Price.
- Once the deposit is paid, the price-adjustment exception above no longer applies to those materials.
- If the Client cancels after the materials have been purchased, CraftHaus will return any returnable materials to the supplier. Supplier restocking fees, return shipping and handling costs are deducted from the deposit.
- The full cost of custom, special-order, cut or non-returnable materials is also deducted from the deposit. The Client may collect those materials within 30 days of cancelling; after that, CraftHaus may dispose of them.
- Any balance of the deposit is refunded to the Client within 10 Working Days of CraftHaus receiving the supplier’s refund. If the deductions are more than the deposit, the Client pays the difference.
- If the Client postpones the Build Start Date, CraftHaus may charge reasonable storage costs for materials held more than 30 days past the original Build Start Date.
24Completion & Deficiencies+
At Substantial Completion, the Client and the Project Manager walk through the finished work together and record any deficiencies in a written list.
CraftHaus will correct the listed deficiencies promptly, and as soon as replacement parts arrive where a part must be ordered. Minor deficiencies that do not prevent use of the space do not delay Substantial Completion or the payment due at that milestone.
Viewing standard. Finished surfaces are assessed without magnification, under normal lighting, from a normal viewing position at least 2 metres (about 6.5 feet) away. A condition visible only from closer than that is not a deficiency.
The final payment is due at Final Completion, less any On-Time Guarantee credit under Section 10.
25Warranties+
CraftHaus Workmanship Warranty. In addition to any warranty that cannot lawfully be excluded, CraftHaus warrants its workmanship for 24 months from Substantial Completion. CraftHaus will respond to a warranty request within 48 hours and will repair, at no cost to the Client, any defect caused by its workmanship.
Warranty service visits. CraftHaus stands behind its work and honours warranty claims. To request warranty service, the Client sends a description and photos or video of the issue through the project WhatsApp group or another established communication channel. Where the issue is clearly covered, CraftHaus books the repair at no cost to the Client.
Where the cause is not clear from the photos or video, and the issue may fall outside the warranty, CraftHaus may ask the Client for a $150 service call hold when booking the visit, either as a credit card pre-authorization or by e-transfer. If the issue turns out to be covered, the hold is released, or the e-transfer is returned in full within 2 Working Days of the visit, and the repair is completed at no cost. If it is not covered, for example a clogged drain or damage caused by impact, misuse or normal use as listed in Section 26, CraftHaus will show the Client the cause and the $150 is kept as a service call fee. Any further work is quoted separately and done only with the Client’s approval.
Materials. For materials CraftHaus supplies, warranty requests go to CraftHaus. CraftHaus will deal with the manufacturer or supplier on the Client’s behalf, subject to that manufacturer’s or supplier’s warranty terms. Warranty information is available to the Client on request.
Client-supplied items. Any material, fixture or appliance supplied by the Client is not covered by the CraftHaus warranty, whether or not CraftHaus installed it.
Recognized Ontario residential construction performance guidelines, including Tarion’s Construction Performance Guidelines, may be used as a reference in assessing workmanship. This does not mean the project is covered by the Tarion warranty program.
Workmanship is assessed using the viewing standard in Section 24.
26Warranty Exclusions+
To the extent permitted by law, the CraftHaus warranty does not cover:
- Normal wear and tear
- Misuse, neglect, or not following care and maintenance instructions
- Damage caused by the Client, occupants, pets or third parties
- Fire, flood, leaks from outside the Scope of Work, severe weather or vandalism
- Pre-existing conditions, systems or structure outside the Scope of Work
- Building settlement or movement not caused by CraftHaus’s work
- Normal shrinkage cracks, nail pops and caulking separation caused by drying and seasonal movement
- Natural variations in colour, grain, veining or texture of natural materials such as wood and stone
- Conditions not visible under the viewing standard in Section 24
- Materials, fixtures or appliances supplied by the Client
- Work altered or repaired by anyone other than CraftHaus after completion
- Damage from failing to maintain reasonable temperature, humidity or ventilation
Nothing in these exclusions limits statutory rights that cannot be waived.
27Communication+
The Client’s questions, requests and concerns go to the Project Manager or the CraftHaus partner who sold the project. That person stays the Client’s point of contact through to completion.
Team members cannot approve changes to the Contract Price, Scope of Work or schedule. Any such change must be confirmed in writing by CraftHaus.
28Client Default+
The Client is in default if they materially breach this Agreement, for example by not making a payment when due, not providing access or approvals, or not following material safety requirements.
CraftHaus will give written notice of the default and a reasonable opportunity to fix it before terminating the Agreement. CraftHaus may pause affected work while a material default remains unresolved, where permitted by law.
29CraftHaus Default+
CraftHaus is in default if it materially breaches this Agreement. The Client will give written notice describing the breach and a reasonable opportunity to correct it before terminating the Agreement.
30Cancellation & Termination+
The Client may have the right to cancel this Agreement within a cooling-off period under Ontario consumer protection legislation. Those rights apply in full and are not limited by anything in this Agreement.
If the Agreement is terminated after Design Approval, the Client pays for work performed, materials ordered or delivered, custom or special-order items that cannot be returned, and approved Change Orders up to the termination date, to the extent permitted by law. CraftHaus will account for all amounts paid and refund any balance owing to the Client.
Termination does not waive any claim or remedy either party has under applicable law.
31Photos & Privacy+
CraftHaus takes progress photos and video to document the work and to send the Client updates.
All photos and video taken by CraftHaus are the property of CraftHaus and may be used in its marketing. CraftHaus will never show the Client’s name, address or family members unless the Client expressly agrees in writing.
The Client’s personal information is used only to deliver the project and is not sold or shared, except with the Client’s express consent where needed for permits, financing or warranty service.
32Disputes+
The parties will first try to resolve any dispute in good faith by direct discussion. Either party may also use any adjudication rights under the Construction Act (Ontario) or any other remedy available under Ontario law.
33General+
Governing law. This Agreement is governed by the laws of Ontario and the federal laws of Canada that apply there.
Entire agreement. The proposal, Scope of Work, these Terms & Conditions, the approved drawings and specifications, the Fixture Sheet and approved Change Orders form the entire Agreement and replace prior discussions about the same work. If they conflict, the order of priority is: approved Change Orders, the proposal and Scope of Work, the approved drawings and Fixture Sheet, then these Terms & Conditions.
Amendments. No change to the Agreement is binding unless it is in writing and approved by both parties.
Severability. If any part of this Agreement is found unenforceable, the rest remains in effect.
Client Acknowledgement
By signing the Agreement, the Client confirms they have reviewed and understood the proposal, Scope of Work and these Terms & Conditions, and had the chance to ask questions before signing.
The Client acknowledges that renovation work involves reasonable construction tolerances, possible concealed conditions, and some temporary noise and disruption.
